If you are using an XSLT 1.0 processor then you need to try

<xsl:apply-templates select="exsl:node-set($union)/*" />

(where the stylesheet declares the xmlns:exsl="http://exslt.org/common" namespace.). Also with some XSLT 1.0 processors like Microsoft's MSXML you need a different namespace.
