your DATE elements are not siblings, they are cousins, they have the
same grantparent (REPORTS) not the same parent (REPORT)

so you want

DATE[not(../preceding-sibling::REPORT/DATE = .)]

As always with this kind of thing using keys would speed it up (search
for muenchian grouping) but get it working before speeding it up!
