  Why?  At first glance, I'd say this mixed content seems legitim.

  It seems you want the modified identity transform pattern, with:

    <xsl:template match="para/text()">
       <emphasis type="default">
          <xsl:copy/>
       </emphasis>
    </xsl:template>
