Beside it's damaged, it doesn't contain any implementation. It's unfeasible to implement dyn:evaluate as extension function for MSXML. It only can be implemented natively by a XSLT processor. Xalan, libxslt and 4XSLT support it, Saxon has a similar one. There is also similar function in EXSLT.NET.
