Perhaps Mike Kay's answer earlier on in this thread could be the solution :

<xsl:value-of select="(thing[lang($mylang)] | thing)[last()] />

either that or change your input doc to :

>    <things>
>      <thing xml:lang="de"/>
>      <thing xml:lang="en"/>
>      <thing/>
>    </things>

In which case the first one in the set will be the default only if there are
no others, so your initial solution would work.
