Hi,
  In regards to the final outcome on the xsl:copy question or xsl:copy thread.
Joerge was correct this turned out to be a bug.  Bub DuCharme suggested the '@*[.!=''|node()] be tried on saxon.   In saxon the non empty attribuet following an empty atribute was matched and copied.

A bug has been entered into bugzilla for xalan.

Also FYI:Xalan does not copy emoty attributes for xsl:copy-of deep copy.  This may not be standed
