I have heard people call HTML many things, but I have not heard it called a protocol. I don't think the presence of a header is close to sufficient for declaring something a protocol.

The absence of headers may be a better sign that something is NOT a protocol, but I can imagine a protocol without headers so long as efficiency isn't a primary goal.
