Should be the actual label. In case of error then the app 
will at least know why. Also, one could argue that getXMLVersion
should report what version the entity is declared as, not what
it should be.

If the document conforms to both versions, why not?
It depends on the application if there is a need
for keeping track of the original/initial version.
