I'm not sure I have any sympathy for this problem. It seems like the people who've tried hardest to push the world to an infoset-centric view of XML are now finding that even that isn't consistent enough for their needs. I think they'd do well to find a data representation solution that actually meets their needs rather than trying to nail XML to a wall.
