I'm having a blackout. Is (para+|(para*, summary)) deterministic?

I would have thought a processor would not be able to determine which
branch the first para that it encounters belongs to, but the
processors I have here accept it. One says <para/><para/><summary/> is
valid, the other says it's not. Which is correct?

What I want is at least one element, at most one summary, and if a
summary appears, it should be the last element.
