The problem with ads is that they may or may not be part of the document content. The author should choose to enable or disable additional functionality imposed over access to the document content, but not to the document site. That is, Gator style ads are legal even if not under the control of the author. What are the user's rights? Does the browsing user have the right to software that stops the browser from doing something they do not want it to do? This is not exactly like spam and telemarketing. If one surfs to a site supported by ads but disables the ads, that is restraint of commerce.
