You could set the minLength facet to 1.

  <xsd:element name="ELEM">
    <xsd:simpleType>
      <xsd:restriction base="xsd:string">
        <xsd:minLength value="1"/>
      </xsd:restriction>
    </xsd:simpleType>
  </xsd:element>
