I don't think this is a fair reading of the W3C process document

 It says "This is a public W3C Working Draft for review by W3C members and
other interested parties"

Thus, the appropriate moment can be the Working Draft.  Granted, it takes a
lot of faith, hope, naivete, or resources to implement WDs since they are
highly subject to change, but non-members who want to participate in the
process are VERY welcome to try implementing WDs and comment on their
problems.  As a matter of fact, that is exactly how one usually becomes an
"invited expert".

Mind you, I agree that many working groups are not sufficiently responsive
to outside input, but this is the style of the WGs, not the policy of the
W3C.
